This website, all Website Material, images, products, artwork, Logos & Trademarks are Intellectual Property of Cheryl Simone Crafts.

 

TERMS AND CONDITIONS OF SALE - UPDATED 4.2.23

We are a small, independent company and we have a generous Angel policy and Terms of Use...

Please respect artistic copyright and their right to earn a living by selling their unique art - please value the artwork you receive from us...it has a real value and has taken a long time to produce. Artists' are rarely appreciated and acknowledged and whilst we thank you wholeheartedly for buying our products and artwork this does not mean that you own that art - it remains the Intellectual Property of the Artist until, and after, their death. Despite what many people think, buying a copy of a digital product does not give you the right to treat it as your own that you can do whatever you like with.

Don't understand what you can and can't do? Compare it to music - you buy the album (digitally or physically) but it does not mean that you own that piece of music, it does not belong to you, you did not create the music, you simply bought a device (the vinyl/CD or the digital file) which lets you play the music created by the artist and it is illegal to reproduce or share that music, as we all know, because it does not belong to you in the first place - the record is simply the licence for you, and you alone, to play it (hence why you cannot play a record in a public place as you do not have the right to share it with a 3rd party).

Art has the same copyright protection as music and is covered by the same laws Internationally, it is very easy to understand in those terms.

 

By purchasing one of our digital products it means you have purchased the right to use it in that format, and that format ONLY, under the following TERMS OF USE:

 

 

You can sell anything you create by hand that is not part of any commercial production process and does not use commercial machinery to produce.

For example, you may not use a sublimation machine, laser machine, 3D printer, etc in any kind of commercial capacity - this is classed as Commercial Use and is not permitted. If you are creating something which is HANDMADE using a 'craft' product such as a Craft die cutting machine, Scan & Cut, Cameo Silhouette etc this is permitted.

 

If you are selling your items through any kind of shop whether it is bricks and mortar or online you can only make 12 identical items.

If you are making wedding stationery you may only make ONE identical stationery set and can make up to 50 identical pieces of stationery within that one set - ie you must change the design for each wedding customer and can only make up to 50 identical invitations, 50 favours etc etc.

 

PSP/Tubes - you may create PSP/Tubes as long as these are not sold or shared and you give full credit to In All Things Stamps.

DIGITAL COLOURING BOOK PAGES AND ASSOCIATED PRODUCTS:

You may print and colour any quantity of coloured pages so long as you HAND COLOUR them using mediums. You can add them to your handmade items to sell but may not copy them in any way. You may print and hand make your own books filled with our colouring pages and GIFT them to family or friends but you are NOT permitted to sell them either for profit or for charity in any way.  Gifting is limited to 10 identical copies.

If you wish to digitally colour you may only do this for your own personal use and may not share, sell or reproduce in any way digitally or physically other than to colour digitally and then to place that colouring onto a handmade item to gift. The artwork, even when coloured DOES NOT BELONG TO YOU therefore you may not sell it in any way except on a handmade item and you may not sell or gift more than 5 identical colourings (changing colour and hue/saturation from your original colouring does not constitute changing the design, the entire colouring must be brand new from scratch for any subsequent designs). 

 

YOU MAY NOT COPY THE DESIGNS IN ANY WAY TO CD, DVD, USB OR OTHER DUPLICATION DEVICE, TO ANOTHER PC, PHONE, TABLET OR OTHER MACHINE SUCH AS AN ELECTRONIC CUTTING MACHINE OR EMBROIDERY MACHINE, ALTHOUGH YOU MAY USE AN ELECTRONIC MACHINE TO CUT YOUR PAGES/FILES FOR YOUR OWN PERSONAL USE ONLY AND MUST CUT FROM THE ORIGINAL FILE. IF YOU REPRODUCE THE FILE IN ANY WAY YOU ARE BREAKING THESE TERMS OF USE AND COPYRIGHT AND ARE BREAKING THE LAW.

DIGITAL STAMPS, RUBBER STAMPS AND ASSOCIATED PRODUCTS

We are more than happy for you to use any of our designs and products to produce hand made items that you make yourself and are permitted to sell those handmade items, either to sell personally or as part of a small business with a maximum turnover of £1000p.a.  We request that you do not make more than 15 of any identical design to sell unless making Wedding Stationery when you are allowed to make 100 identical items.

Under the terms above you are permitted to sell any handmade items you make on Facebook, Ebay, Etsy and other selling platforms.

YOU MAY NOT: sell, share, copy or duplicate a CD or digital product to a 3rd party - this INCLUDES sharing with friends and family and includes sharing a CD between different computers or allowing someone to copy a product to a secondary device such as a Memory Stick or USB stick, dongle etc.  YOU MAY NOT UNDER ANY CIRCUMSTANCES share any of our digital products with a 3rd party website such as a file hosting server in any way unless you are backing up your PC/Mac to a cloud server and you must be 100% sure that your 3rd party host is offering a secure platform which cannot be compromised in any way.

You are not permitted to sell packs of items which include pre-printed or pre-stamped In All Things Stamps images (ie you may not print sheets off a download/In All Things Stamps CD and sell them on or create your own sheets to sell, this requires a commercial license which you can purchase separately on request).

CLASSES: If you run a small workshop/class and wish to use our products within your class to teach students (paid/unpaid) we are happy for you to do this within your class environment. You may print copies of images for the class to use within that class only as part of a kit you put together yourself. If you wish your students to have extra copies to take home with them to practice, or if they cannot finish in the class and need to take images home to finish you can issue them with TWO copies - one to use in the class and one to take home. YOU are responsible for telling the students that copyright applies and that they may not further copy or share those images in any way. The students may sell anything they hand make with those images/stamps produced from the class. You must give credit to In All Things Stamps for the images used within your class kit and tell your students where they can purchase further images. WE ARE VERY HAPPY TO PUT TOGETHER SPECIFIC WORKSHOP KITS FOR YOU FOR A SMALL CHARGE - please email us for further details of how many you need and the price of your class etc and we will try to give you a kit which gives you a class profit and meets the needs of your students. 

ALTERED IMAGES: You are permitted to merge digital images together to produce another version for PERSONAL USE ONLY. Ie you can take an image of a girl and add it to a boy to make a couple etc. YOU MAY NOT SHARE, SELL or COPY this 3rd image. 

KITS: You are absolutely NOT permitted to create kits to share or sell using any of our products/images other than in the class environment outlines above. You may not produce kits to sell for charity. 

 

You may not use our images as part of a Logo or Corporate Identity in any way, including website avatars, blinkies and other html content.

It contravenes our commercial manufacturing and design Copyright and UK Copyright Law for you to copy, resell or redistribute any of our products, whether on disk or digitally. In addition you are not permitted to reconfigure our designs to use them to resell or redistribute them in any way, either wholly or as part of another design, as a derivative design, either digitally or in printed format, particularly on auction sites or share sites, including social media platforms.

The In All Things Stamps logo, Cheryl Simone Crafts logo, are all trademarks which belong to Cheryl Simone Crafts and Cheryl Spence. You are not permitted to use any of these logos in commercial work unless with permission from the company or unless you are promoting In All Things Stamps on our behalf.

 

We will take legal action against anyone found to be disregarding our legal Copyright. 

 

USING OUR PRODUCTS WITH THE BROTHER SCAN N CUT MACHINE OR OTHER SPECIFIC CRAFT MACHINERY/SOFTWARE/EMBROIDERY MACHINES ETC...

We are crafters ourselves and we understand what you want to be able to create at home using our products....

SERIF CRAFT ARTIST/OTHER CRAFTING SOFTWARE: We are happy for you to use any of our digital products with other Software to create scrap pages and cards digitally but you must still adhere to the angel policy above when creating your own designs. You MAY NOT sell, share or give away any 'derived' artwork you create from our original images.

BROTHER SCAN N CUT MACHINE/CRAFT ROBO/CAMEO SILHOUETTE MACHINE ETC...We encourage and are happy for you to use any of our digital products (this includes CD collections which are digital products) with your cutting machines to cut out images and manipulate them for your own personal use as you wish. You may NOT save those images so that you create an additional copy.

EMBROIDERY/CROSS-STITCH/SOFT CRAFT: You MAY NOT reproduce our images/files to create an embroidery/cross-stitch (and other similar items) pattern or file other than for personal use (RETRICTED TO 10 ITEMS). Under no circumstances can you use our images/files to create any kind of pattern or derivative pattern and then share, sell or distribute that pattern/derivative pattern to any other 3rd party. You may use any of our images/files for personal use with for example, an embroidery machine for PERSONAL USE ONLY. 

YOU MAY NOT UNDER ANY CIRCUMSTANCES scan any of our rubber/polymer stamps to a machine or any other software to manipulate that image in any way, shape or form.

You CAN scan our stamped images to enable a machine to cut the image out for you in it’s original format. You may not resize it, change it, manipulate it or weld it to any other image whatsoever.

 

If you are in doubt our rule is - if you can apply the stamp onto a surface, ink it and then cut it with scissors or a craft knife without resizing or manipulating or masking it in any way it is allowed! Your cutting machine should only be used as a tool to cut the original stamped image and may not be used to save the stamp image or to change the original in any way. This breaks our Copyright policy and is illegal.

We strongly believe that we offer our customers some of the best value products available. As a small business we rely on our own ideas and talents to work in a business where we can support ourselves and our family and we kindly request that you respect our beliefs and wishes. 

 

Copyright theft, whether willingly or unknowingly, is a serious crime and undermines the industries where it is found. We find that people have a great disregard for artists and their ownership rights to artwork - by undermining those rights we risk undermining the industry itself. In the Craft business this is particularly the case as it consists of 1000's of small businesses, many run from home by people who just wish to make a decent, honest living by sharing their artistic talents with and inspiring others.  Those creative artists are the people who inspire others to manufacture and bring new products and ideas to the marketplace - without their work the craft industry would be a boring place indeed. 

 

Please respect artist's copyright and do not illegally share their work - it only takes a moment of your time to refer to an artist and thank them for inspiring you with a design.
